These Terms & Conditions ("Terms") govern your access to and use of the Zone Artificial platform, dashboard, and related services (collectively, the "Service"). By creating an account or using the Service you agree to these Terms.

1. Definitions

• "Zone Artificial", "we", "us" — the operator of the Service.
• "Customer", "you" — the organization or individual who creates an account.
• "Workspace" — a tenant of the Service owned by a Customer.
• "User" — an individual with a credential to access a Workspace.
• "Content" — any data, configuration, files, or information you submit to or generate within the Service.

2. Eligibility and account

You must be at least 18 years old and authorized to bind the organization you represent. You are responsible for keeping credentials secure and for all activity in your Workspace. Notify us immediately at info@zoneartificial.com if you suspect unauthorized access.

3. Subscription, billing and refunds

Paid plans renew automatically at the cadence selected at sign-up unless cancelled before the renewal date. Fees are charged in advance and are non-refundable except where required by law. You may cancel at any time from the billing area in your dashboard; cancellation takes effect at the end of the current billing period. Taxes, if applicable, are added in accordance with your billing address.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or third-party right.
• Send spam, malware, or any content prohibited by an advertising platform you have connected.
• Reverse engineer, scrape at scale, or interfere with the integrity of the Service.
• Bypass billing, rate limits, or feature gates.
• Process special-category personal data (health, biometric, etc.) without a lawful basis and adequate safeguards.

5. Third-party integrations

The Service connects to platforms operated by third parties (Google, Meta, Shopify, payment providers, AI providers, etc.). Your use of those platforms remains subject to their terms. We are not responsible for failures, changes, or outages of third-party systems.

6. AI features

AI features produce recommendations, summaries, and analyses based on your data. Output is provided as an aid; you remain solely responsible for decisions you make and actions you take. We do not guarantee specific advertising results.

7. Customer Content and IP

You retain all rights in your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, and display your Content solely to operate and improve the Service for you. We do not use your Content to train foundation models or for any purpose outside your Workspace, except in aggregated and anonymized form to measure platform performance.

8. Confidentiality

Each party shall protect the other party's confidential information with the same degree of care it uses for its own (no less than reasonable care). Confidential information does not include information that is or becomes public through no fault of the receiving party.

9. Suspension and termination

We may suspend or terminate access for material breach of these Terms, abuse, or unpaid invoices, after reasonable notice when feasible. You may terminate at any time by closing your account. On termination, your Content is deleted within 90 days, subject to legal retention obligations.

10. Disclaimer

The Service is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of liability

To the maximum extent permitted by law, neither party shall be liable for indirect, incidental, special, consequential, or punitive damages. Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnity

You agree to indemnify and hold us harmless from any third-party claim arising out of your Content, your use of the Service in violation of these Terms, or your breach of applicable law.

13. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated by email or via the dashboard at least 14 days before taking effect. Continued use after the effective date constitutes acceptance.

14. Governing law

These Terms are governed by the laws of the Republic of Türkiye, excluding its conflict-of-laws rules. Any dispute will be resolved exclusively before the competent courts and execution offices of Eskişehir, Türkiye, except where mandatory consumer-protection law of your residence provides otherwise.
